Terms of Service

By accessing or using Wellbooked ("the Service"), operated at wellbooked.net, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Wellbooked ("we," "us," or "our"), based in Eugene, Oregon, USA.

Wellbooked is a scheduling platform that allows hosts ("Bookees") to set their availability, share a booking link, and let guests ("Bookers") schedule appointments without back-and-forth communication.

The Service is available across three subscription plans — Starter, Pro, and Expert — each billed monthly. All plans include a 30-day free trial period. An embeddable booking widget is available for use on third-party websites.

To use Wellbooked as a Bookee (host), you must create an account using an email address and password, or through Google or Apple authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate, current, and complete information during registration and to update it as necessary. Each individual may maintain only one account.

Bookers (guests) do not need to create an account to schedule appointments.

You agree not to:

• Use the Service for spam, fraudulent, or illegal activity
• Impersonate another person or entity
• Create automated or fake bookings
• Reverse engineer, scrape, or attempt to extract the source code of the Service
• Intentionally overload or disrupt the Service's infrastructure
• Use the Service to transmit malware, viruses, or harmful content

Wellbooked reserves the right to suspend or terminate any account that violates these Terms, with or without notice.

Wellbooked offers monthly subscription plans processed through Stripe. All new accounts begin with a 30-day free trial. A valid payment method is required to start the trial, but no charges are made until the trial period ends and you approve your first charge.

Subscriptions renew automatically on a monthly basis. You may cancel your subscription at any time. No refunds are issued for partial months of service.

All credit card information is collected and stored entirely by Stripe. Wellbooked never sees, stores, or processes your card details directly.

Wellbooked may adjust pricing with at least 30 days' advance notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

Wellbooked and its original content, features, and functionality are owned by Wellbooked and are protected by copyright, trademark, and other applicable laws.

You retain ownership of the content you upload to the Service, including profile information, logos, banners, and booking details. By uploading content, you grant Wellbooked a limited, non-exclusive license to display and use that content solely as necessary to operate and provide the Service.

You are responsible for all content you upload to Wellbooked, including logos, banner images, bios, welcome messages, and other profile information. Your content must not infringe on the intellectual property rights of any third party or contain unlawful material.

Wellbooked reserves the right to remove content that violates these Terms or that we reasonably believe to be harmful, misleading, or inappropriate.

Wellbooked integrates with third-party services including Google Calendar, Apple Calendar, Stripe, and others. Your use of these third-party services is governed by their respective terms of service and privacy policies.

Wellbooked is not responsible for outages, changes, or issues caused by third-party service providers.

Wellbooked syncs with external calendars (Google Calendar, Apple Calendar) to help prevent scheduling conflicts. While we strive for accuracy and timeliness, Wellbooked is not liable for scheduling conflicts that may arise from delays in calendar synchronization or third-party API issues.

Wellbooked provides users with a publicly accessible iCal feed URL for subscribing to their schedule in external calendar applications. You are responsible for controlling who has access to this URL, as anyone with the URL can view your schedule data.

Wellbooked provides an embeddable booking widget that you may place on third-party websites. You are responsible for ensuring the use of the embed complies with the hosting website's terms and policies.

Either party may terminate this agreement at any time. You may cancel your subscription and delete your account through your account settings. Wellbooked may suspend or terminate accounts for violations of these Terms.

Upon termination, your personal data will be handled in accordance with our Privacy Policy.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Wellbooked does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Wellbooked is not liable for missed appointments, calendar synchronization issues, or failures of third-party services.

To the maximum extent permitted by law, Wellbooked's total liability for any claims arising from or related to the Service shall not exceed the total amount you paid to Wellbooked in the twelve (12) months preceding the claim.

In no event shall Wellbooked be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

You agree to indemnify, defend, and hold harmless Wellbooked, its owner, and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

Wellbooked reserves the right to modify these Terms at any time. We will notify users of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Lane County, Oregon.
